Issues Franchises Commonly Face

Owning a franchise should be smooth sailing, but often, it isn’t. Frequently, franchisees find their main issues stemming not from bad business, but instead from their franchisors. Though you’d think franchisors would always want the best for their franchisees, as they do represent and make money for the franchise itself, unfortunately, this isn’t always the case. Sometimes, franchisors will turn on their franchisees if they believe it will help their bottom line. If you find yourself in this situation, you’d be best served with an experienced Wisconsin franchise lawyer in your corner who can help you fight for the outcome you need to continue operating a successful business. Just some of the issues we help our clients with are as follows:

  • Breach of Contract
  • Fraud
  • FDD disclosure violations
  • Encroachment
  • Failure to renew
  • Unreasonable system-wide changes
  • Supply chain sourcing and pricing
  • Termination
  • Non-compete clauses
  • Franchise Renewals
  • Franchise sales or transfers
  • Churning

If you’re facing any of these issues, or any other issue pertaining to your franchise, you can depend on our experienced Wisconsin franchise lawyer to fight for the outcome you deserve.

Starting a Franchise in Wisconsin

The Securities Division of the Wisconsin State Department of Financial Institutions is tasked with implementing the Wisconsin Franchise Investment Law. The Division also manages the FDD registration and application process which appears through an online filing system. Applications for FDD registration and renewal must be filed electronically with the Securities Division through the Division’s e-filing portal. Wisconsin does not accept FDD registrations or filings by mail. For inquiries (not for FDD Filings) the email address for the Division is DFIDLSecuritiesEnforcement@wisconsin.gov and their phone number is (608) 266-0448.
